DAILYZDEAL TERMS OF SERVICE AND VIP MEMBERSHIP TERMS

Please read these Terms of Service and VIP Membership Terms carefully before using the Dailyzdeal website or purchasing any digital product.

These Terms form a legally binding agreement between you (“you” or “your”) and Dailyzdeal (“Dailyzdeal,” “we,” “our,” or “us”).

By placing an order, checking the required agreement box at checkout, and submitting your payment information, you confirm that you have read and accepted these Terms. You also expressly agree to be enrolled in the Dailyzdeal VIP membership under the trial, recurring billing, cancellation, and refund terms described below.

If you do not agree to these Terms or do not wish to enroll in Dailyzdeal VIP, do not check the agreement box or complete your purchase.

IMPORTANT VIP TRIAL AND AUTOMATIC-RENEWAL NOTICE

EVERY QUALIFYING PURCHASE MADE THROUGH THE DAILYZDEAL WEBSITE AUTOMATICALLY ENROLLS THE CUSTOMER IN DAILYZDEAL VIP.

Dailyzdeal VIP is included as part of the purchase terms displayed and accepted at checkout.

When you place an order:

  • You receive a 2-day free trial of Dailyzdeal VIP.

  • You are charged immediately for the digital product included in your order.

  • You are not charged the $39.99 VIP membership fee during the 2-day trial.

  • Unless you cancel before the trial expires, your payment method will automatically be charged $39.99 USD, plus applicable taxes, when the trial ends.

  • Your Dailyzdeal VIP membership will then automatically renew every 30 days.

  • You will be charged $39.99 USD, plus applicable taxes, every 30 days until you cancel.

  • No additional confirmation will be requested before the post-trial or renewal charges are processed.

  • You may cancel future renewals using the cancellation method described in these Terms.

  • Membership fees already charged are final and non-refundable except where required by applicable law or approved by Dailyzdeal in its sole discretion.

You cannot complete a purchase without checking the required box confirming that you have read, understood, and agreed to these Terms, including the Dailyzdeal VIP trial and automatic-renewal provisions.

1. ABOUT DAILYZDEAL

Dailyzdeal is an online store offering curated digital eBooks, digital collections, and related digital content at discounted prices.

All products are delivered digitally through the email address provided during checkout or through another electronic-access method.

Dailyzdeal does not sell or ship physical products and does not maintain physical retail locations.

Any reference to “delivery” in these Terms means electronic delivery by email, attachment, download link, account access, or another digital method.

2. ELIGIBILITY

By accessing our website or placing an order, you confirm that:

  • You are at least 18 years old or have permission from a parent or legal guardian.

  • You are legally capable of entering into a binding agreement.

  • The information you provide is accurate, current, and complete.

  • You are authorized to use the payment method provided.

  • You understand that completing a purchase enrolls you in Dailyzdeal VIP.

  • You agree to the 2-day trial and recurring billing terms displayed at checkout and contained in these Terms.

We may refuse, suspend, or terminate access if we reasonably believe these requirements have not been satisfied.

3. PRODUCTS AND PRICING

All prices displayed on Dailyzdeal are stated in U.S. dollars unless otherwise indicated.

Product prices are separate from the Dailyzdeal VIP membership fee unless the checkout page expressly states otherwise.

Prices, product availability, descriptions, discounts, promotional offers, digital collections, and VIP benefits may be changed, limited, or discontinued at any time.

Discounts and promotional offers cannot be combined unless expressly stated.

We make reasonable efforts to display accurate product descriptions. However, minor errors, omissions, or formatting differences may occasionally occur.

4. ORDERS AND PAYMENT AUTHORIZATION

By submitting an order and checking the required agreement box, you expressly authorize Dailyzdeal and its payment processors to charge your selected payment method for:

  • The displayed price of your digital product;

  • Any applicable taxes;

  • The $39.99 Dailyzdeal VIP fee after the 2-day trial expires, unless you cancel before the trial ends; and

  • The recurring $39.99 Dailyzdeal VIP fee every 30 days thereafter until you cancel.

Your digital-product charge may be processed immediately.

Your initial VIP membership charge will be processed after the 2-day trial expires. No additional authorization or confirmation will be requested before that charge or any subsequent renewal charge is processed.

You represent that you are legally authorized to use the payment method submitted.

We may cancel, refuse, or limit an order in cases involving suspected fraud, unauthorized payment activity, duplicate orders, technical errors, pricing mistakes, promotional abuse, or violations of these Terms.

If Dailyzdeal cancels an order before the digital product is delivered, the applicable digital-product charge will be refunded or voided.

Your bank or card provider may impose currency-conversion, overdraft, international-transaction, or other fees. Dailyzdeal does not control and is not responsible for those fees.

5. DIGITAL DELIVERY

Digital products are delivered to the email address entered during checkout.

Delivery may include:

  • An attached digital file;

  • A download link;

  • Account-access instructions; or

  • Another electronic method for accessing the purchased content.

You are responsible for:

  • Entering a complete and accurate email address;

  • Checking your inbox, spam, junk, promotions, and blocked-sender folders;

  • Maintaining sufficient inbox storage;

  • Ensuring your device can open the delivered file format; and

  • Downloading and safely storing your purchased files.

A digital product is considered delivered when the delivery email, attachment, download link, or access instructions are successfully sent to the email address provided during checkout or made available through your account.

Dailyzdeal is not responsible for delivery problems caused by an incorrect email address, full inbox, spam filter, email-provider restriction, unsupported device, deleted email, internet interruption, or another circumstance outside our reasonable control.

If you do not receive your digital product, contact support@dailyzdeals.com. After confirming your order, we will make reasonable efforts to resend the product or correct the delivery issue.

6. DIGITAL-PRODUCT REFUND POLICY

Because Dailyzdeal products are digital and are delivered through email or electronic access, they may be opened, downloaded, copied, or saved immediately after delivery.

For that reason, all digital-product sales are final once the delivery email, attachment, download link, or access instructions have been sent.

We do not accept returns, refunds, exchanges, or order cancellations because:

  • You changed your mind;

  • You made an accidental purchase;

  • You purchased the wrong product;

  • You did not read the product description;

  • You no longer want or need the content;

  • You failed to check your spam or junk folder;

  • You provided an incorrect email address;

  • Your device cannot open a standard digital file;

  • You already owned some or all of the included content;

  • You did not open, download, or use the delivered product; or

  • You did not understand that the purchase included Dailyzdeal VIP enrollment after agreeing to the disclosed checkout terms.

If you received an incorrect, damaged, or unusable file, contact us within seven days of purchase.

When appropriate, we may resend, replace, repair, or otherwise correct the digital file or delivery issue.

A delivery problem does not automatically qualify for a refund when we can successfully resend the product or provide access through another electronic-delivery method.

Refunds may be issued where required by applicable law or when Dailyzdeal determines, in its sole discretion, that a refund is appropriate.

Nothing in this policy limits any non-waivable rights involving confirmed unauthorized or duplicate charges.

7. DAILYZDEAL VIP MEMBERSHIP

7.1 Automatic Enrollment With Purchase

Every qualifying product purchase completed through the Dailyzdeal website automatically enrolls the purchaser in Dailyzdeal VIP.

Dailyzdeal VIP is part of the transaction presented at checkout. It is not a separately shipped product.

Before completing the transaction, customers are required to check a box confirming that they have read, understood, and agreed to:

  • These Terms;

  • Automatic Dailyzdeal VIP enrollment;

  • The 2-day free trial;

  • The $39.99 post-trial membership charge;

  • Automatic renewal every 30 days;

  • The cancellation procedure; and

  • The applicable refund terms.

Customers who do not wish to accept these terms must not check the agreement box or complete the purchase.

7.2 Membership Benefits

Dailyzdeal VIP may provide access to:

  • Members-only digital content;

  • Curated eBook collections;

  • Premium digital resources;

  • Special offers;

  • Promotional pricing;

  • Early-access opportunities; and

  • Other benefits displayed on our website.

Membership benefits may change over time. We may add, remove, replace, or modify membership content and benefits.

Any change to the recurring membership price will be handled as described in these Terms and applicable law.

7.3 Two-Day Free Trial

Your 2-day free trial begins when your qualifying product order is successfully submitted.

The trial lasts two calendar days, approximately 48 hours, beginning at the time the order is completed.

You will be charged immediately for your digital-product purchase, but you will not be charged the $39.99 VIP membership fee during the trial.

Unless you cancel before the trial expires, your trial will automatically convert into a paid Dailyzdeal VIP membership.

The trial is generally limited to one trial per person, household, account, email address, or payment method.

Creating additional accounts or using different information to obtain repeated free trials is prohibited.

7.4 Post-Trial Charge

Unless you cancel before the 2-day trial expires, your payment method will automatically be charged $39.99 USD, plus applicable taxes, immediately after the trial ends.

By completing your purchase and checking the required agreement box, you expressly authorize Dailyzdeal to process this charge without requesting additional confirmation.

7.5 Automatic 30-Day Renewals

After the initial $39.99 membership charge, Dailyzdeal VIP automatically renews every 30 days.

Your payment method will automatically be charged $39.99 USD, plus applicable taxes, every 30 days until you cancel.

No additional authorization will be requested before each renewal charge.

The exact billing date may vary slightly because of weekends, payment-processing delays, declined payments, or technical circumstances.

7.6 Cancellation

You may cancel Dailyzdeal VIP at any time by:

  • Using any membership-cancellation option made available through your account or our website; or

  • Emailing support@dailyzdeals.com from the email address associated with your order or membership.

Your cancellation request should include your full name and the email address connected to your membership.

To avoid the first $39.99 membership charge, your cancellation must be completed before the 2-day trial expires.

To avoid a future renewal charge, your cancellation must be completed before the next 30-day charge is processed.

After cancellation:

  • Future automatic-renewal charges will stop;

  • You will not be charged for another membership period;

  • Your membership access may continue through the end of an already-paid billing period; and

  • Previously charged membership fees will not be refunded or prorated except where required by law.

Deleting an email, failing to use the membership, disputing the original digital-product purchase, or no longer visiting the website does not automatically cancel Dailyzdeal VIP.

You must complete the cancellation process described above.

7.7 Failed Payments

If a membership payment cannot be processed, we may:

  • Attempt to process the payment again;

  • Request an updated payment method;

  • Restrict VIP benefits;

  • Suspend membership access; or

  • Cancel the membership.

You remain responsible for valid fees incurred before cancellation.

7.8 Membership Price Changes

We may change the Dailyzdeal VIP membership price.

Where required, we will provide reasonable advance notice before applying an increased price to a future billing period.

Continuing the membership after the effective date of a properly disclosed price change constitutes acceptance of the new price.

You may cancel before the changed price takes effect.

7.9 VIP Refund Policy

Dailyzdeal VIP membership fees are final and non-refundable once charged, including when:

  • You forgot to cancel during the trial;

  • You forgot to cancel before a renewal;

  • You did not use the membership;

  • You did not access or download VIP content;

  • You cancel after a charge was processed;

  • You used only part of the paid membership period;

  • You failed to read the Terms after checking the required agreement box; or

  • You no longer want the membership.

We do not provide prorated or partial refunds for unused membership time.

We may correct confirmed duplicate or unauthorized charges.

Refunds may also be provided where required by applicable law or approved by Dailyzdeal in its sole discretion.

8. PERSONAL-USE DIGITAL LICENSE

Purchasing or accessing a digital product gives you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the product for personal, noncommercial purposes.

A purchase does not transfer ownership of copyrights, trademarks, publishing rights, or other intellectual-property rights.

You may not:

  • Resell a digital product;

  • Redistribute or publicly share the product;

  • Share a file or download link with another person;

  • Upload the content to a website, marketplace, social-media platform, or file-sharing service;

  • Copy or reproduce the content for commercial use;

  • Remove ownership or copyright notices;

  • Claim the content as your own; or

  • Modify and redistribute the content as a separate product.

Unauthorized copying, resale, sharing, or redistribution may result in termination of access and legal action.

9. INTELLECTUAL PROPERTY

The Dailyzdeal website, name, logos, branding, page designs, original text, graphics, promotional materials, software, and other original website content are owned by or licensed to Dailyzdeal.

Individual eBook titles, written content, illustrations, and other third-party materials remain the intellectual property of their respective authors, publishers, licensors, or rights holders.

Nothing in these Terms grants permission to reproduce or use Dailyzdeal branding or website content except as necessary to access our services for personal use.

10. ACCOUNTS AND SECURITY

Certain VIP benefits may require an account.

You are responsible for:

  • Providing accurate account information;

  • Maintaining the confidentiality of your login credentials;

  • Restricting unauthorized account access;

  • Updating your information when it changes; and

  • Notifying us promptly of suspected unauthorized activity.

We may refuse, restrict, suspend, or terminate an account associated with fraud, unauthorized sharing, payment abuse, repeated trial abuse, chargeback abuse, or violations of these Terms.

11. PROHIBITED CONDUCT

You may not use or attempt to use Dailyzdeal to:

  • Violate any applicable law;

  • Provide false or misleading information;

  • Impersonate another person or business;

  • Use an unauthorized payment method;

  • Obtain repeated free trials through duplicate information;

  • Resell or redistribute digital products;

  • Share VIP access with unauthorized users;

  • Access accounts or content without authorization;

  • Introduce malware or harmful code;

  • Interfere with website security or operation;

  • Scrape or automatically collect website data;

  • Reverse engineer website software;

  • Circumvent digital-access restrictions; or

  • Abuse refunds, chargebacks, promotions, trials, or customer-support processes.

12. COMMUNICATIONS

By placing an order and enrolling in Dailyzdeal VIP, you consent to receive transactional communications involving:

  • Order confirmation;

  • Digital-product delivery;

  • Download instructions;

  • Payment receipts;

  • Trial information;

  • Membership billing;

  • Renewals;

  • Cancellation confirmation;

  • Account security;

  • Customer-support responses; and

  • Changes to these Terms or our Privacy Policy.

Transactional communications may still be sent if you unsubscribe from promotional marketing emails.

13. THIRD-PARTY SERVICES

Our website may use third-party payment processors, email providers, hosting services, analytics providers, publishers, licensors, and other service providers.

Dailyzdeal does not control all third-party services and is not responsible for their separate availability, security, content, privacy practices, or actions.

Your use of a third-party service may also be governed by that provider’s terms and policies.

14. SERVICE AVAILABILITY

We do not guarantee that the website, membership area, digital files, or download links will always be uninterrupted, secure, or error-free.

We may update content, correct errors, conduct maintenance, modify features, or temporarily restrict access.

If a technical issue prevents access to a purchased product, our primary remedy may be to resend the file, restore access, or provide a replacement download link.

15. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, DIGITAL PRODUCTS, MEMBERSHIP BENEFITS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

DAILYZDEAL DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.

WE DO NOT GUARANTEE THAT:

  • A DIGITAL PRODUCT WILL MEET YOUR PERSONAL EXPECTATIONS;

  • THE WEBSITE WILL OPERATE WITHOUT INTERRUPTION;

  • EVERY FILE WILL WORK WITH EVERY DEVICE OR PROGRAM;

  • ALL MEMBERSHIP CONTENT WILL REMAIN AVAILABLE INDEFINITELY; OR

  • USING A DIGITAL PRODUCT WILL PRODUCE A PARTICULAR RESULT.

16. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, DAILYZDEAL AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

This includes lost data, lost profits, loss of business, loss of privacy, device issues, inability to access content, or the cost of substitute products or services.

To the fullest extent permitted by law, Dailyzdeal’s total liability for a claim will not exceed the greater of:

  • The amount you paid Dailyzdeal for the product or membership giving rise to the claim during the six months before the claim arose; or

  • $100 USD.

17. INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Dailyzdeal and its owners, employees, contractors, affiliates, licensors, and service providers from claims, losses, liabilities, and reasonable legal expenses arising from:

  • Your violation of these Terms;

  • Misuse of the website or digital content;

  • Unauthorized sharing or resale;

  • Violation of another party’s rights; or

  • Fraudulent or unlawful activity connected to your account.

18. TERMINATION

You may stop using the website at any time.

Stopping use of the website, deleting an email, or abandoning your account does not automatically cancel Dailyzdeal VIP. You must cancel using the process described in Section 7.

We may suspend or terminate access if you violate these Terms, engage in fraud, share or resell digital products, abuse free trials, create a security risk, or fail to pay valid charges.

19. INFORMAL DISPUTE RESOLUTION

Before starting formal legal proceedings, you and Dailyzdeal agree to attempt to resolve the dispute informally.

Send a written description of the dispute to support@dailyzdeals.com, including your name, order email, relevant order information, the nature of the issue, and your requested resolution.

The parties will have 30 days after receipt of the notice to attempt to resolve the dispute.

20. GOVERNING LAW

These Terms are governed by the laws applicable to Dailyzdeal’s principal place of business and applicable United States federal law, without regard to conflict-of-law principles.

Any dispute not otherwise subject to a valid arbitration agreement must be brought in a court with proper jurisdiction, unless applicable consumer law requires a different location.

21. CHANGES TO THESE TERMS

Dailyzdeal may update these Terms periodically.

Material changes will be posted with an updated revision date. We may also provide notice by email or through the website where required.

Changes will apply prospectively. Continued use of Dailyzdeal after the updated Terms become effective constitutes acceptance of the revised Terms.

22. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

23. ENTIRE AGREEMENT

These Terms, the Dailyzdeal Privacy Policy, and the disclosures presented and accepted at checkout form the entire agreement between you and Dailyzdeal concerning digital products and Dailyzdeal VIP.
